Annotation
Under the influence of digitalization in the sphere of labor, labor law is adapting to the ongoing changes in the digital economy, including in terms of the exercise of employer power and the exercise of employer control as a component of employer power. Whereas in the past control was often exercised directly by the employer, nowadays employers use technical means, including artificial intelligence, as tools to control the fulfillment of employees’ labor function. All this poses challenges to labor law regulation. This article will discuss the issues of the employer’s choice within its power to exercise employer control, the impact of new information technologies on this choice in the context of the topic under consideration, as well as the legal aspects of exercising control.
