SOME PROBLEMS OF THE INSTITUTE OF WITNESS IMMUNITY IN CIVIL PROCEEDINGS

This article discusses the functioning of witness immunity in civil proceedings. The relevance of the research topic is determined by the fact that at the moment there is insufficient development of the features of witness immunity both in the norms of the Code of Civil Procedure of the Russian Federation and in the existing theoretical works of legal scholars. The article solves the following research problems: firstly, to define the concept of witness immunity, secondly, to explore the classification of witness immunity in civil proceedings and to propose the author’s variation of witness immunity, thirdly, to consider the subject composition of persons entitled to refuse to give testimony. The author indicates that the existing circle of persons with the right of witness immunity requires adjustment. This article focuses on the absence of the category “limits of witness immunity”, which serves as a certain measurement of the effect of witness immunity in each specific case. Recommendations are offered for protecting the rights and interests of witnesses when implementing the institution of witness immunity in civil proceedings.
