Annotation
The article deals with one of the acute problems of the theory of evidence law that is proof in criminal cases. According to the author the concept of proof in Art. 85 of the Criminal Procedure Code of the Russian Federationdoes not correspond to the tasks of criminal proceedings and the realities of criminal procedural activity. In this article of the CPC, only the collection, verification and evaluation of evidence are referred to the concept of proof. Arguments which indicate that a single process of proof consistsof the use of evidence along with the indicated elementsare presented. A new definition of the concept of proof is proposed and should be included in the specified article of the criminal procedure law.
