Annotation
The article considers the problem of the proper definition of such encumbrances as mortgages, including in relation to the pledge of residential premises. The accuracy
of the definition will allow participants in civil law relations to realize all the legal possibilities provided by this type of collateral. The article discusses both the main obligations and the requirements of these obligations, the implementation of which can provide a mortgage. A general analysis of the mortgage subject has also been carried out, including, within the framework of special regulation, not only real estate. The incorrectness of the definition of residential premises in the legislation, which cannot be the subject of a mortgage, is indicated as problematic aspects. Based on the results of the study, the author suggests correcting the current mortgage legislation in order to form an unambiguous law enforcement practice of mortgage origination.
