Annotation
The article raises the question of revising the main provisions in the theory of evidence and criminal proceedings such as the concepts of evidence and proof. According
to the author, evidence should not be called “any information”, as indicated in part 1 of Art. 74 of the Code of Criminal Procedure of the Russian Federation, but the evidentiary facts contained in the protocols of investigative and judicial actions, the conclusions and testimony of an expert (specialist), and other documents. It is proposed to abandon the term “collecting evidence”, because the result of the reflection of the event under study is not evidence but various traces of this event. Evidence according to the author does not comprise collecting, verification and evaluation of evidence but their formation and use in order to establish the circumstances which the correct resolution of the criminal case depends on.
