Annotation
The article is devoted to a comparative legal analysis of the regulation of conflicts of interest arising in the field of public procurement of the Russian Federation and the European Union. The problem chosen by the author is due to the fact that a conflict of interest in decision-making is itself the root cause of many forms of corruption
and can significantly distort the distribution of public resources. Considering the special role of public procurement as a means of meeting the needs of the entire
government apparatus, the need to form a preventive system of legal regulation of conflicts of interest is of paramount importance. Based on the comparative legal method, the author outlines the approaches of European and domestic legislation to the regulation of procurement relations affected by conflicts of interest. Based on the studied provisions of regulatory legal acts, as well as judicial practice, the author identifies individual problems arising from the existing legal regulation and suggests possible ways to overcome them.
