THE LEGAL NATURE AND ESSENCE OF POSITIVE AND NEGATIVE RESPONSIBILITY IN INTERNATIONAL LAW

Annotation

The article deals with topical issues of international legal responsibility in the context of its traditional division into positive and negative for the science of international law. The purpose of the article is to reveal the legal nature and essence of positive and negative responsibility in international law. This goal predetermined the formulation of a number of tasks: to determine the content of positive and negative responsibility; to compare positive and negative responsibility, revealing not only their opposite, but also mutual influence; to analyze the reasons for the critical attitude to the institution of responsibility in international law at the present stage. As a result of the work, it was established that positive responsibility plays a key role for international law as a whole, while the concept of negative responsibility is paramount for the institute of international legal responsibility; it was confirmed that international legal responsibility is an intersectoral institute of international law that ensures the implementation of international legal norms in its various branches; it is proved that insufficient practical implementation of both positive and negative international legal responsibility is associated with the crisis state of modern international law as a whole.
