PROBLEMS OF CRIMINAL LAW REGULATION OF ARTIFICIAL INTELLIGENCE AND WAYS TO SOLVE THEM

The aim of the study is to identify and disclose the main problems of applying the rules on criminal liability for committing crimes, in the mechanism of which the use of artificial intelligence technologies plays a significant role, as well as highlighting solutions to these problems. Methodology includes general scientific methods of cognition, a documentary method that allowed to highlight the characteristic features of criminal acts related to the use of intellectual technologies from publications and messages, as well as a formal legal method used to interpret legal norms governing relations involving artificial intelligence. Results include the identification of the possibility of using modern artificial intelligence technologies for criminal purposes. It is proved that already at the reached stage of development such intelligent systems are able to realize the objective side of the crime in their actions. It is revealed that the content of the guilt of artificial intelligence has the same characteristics as the intellectual and volitional categories of human activity. In addition, the study of subjective signs made it possible to identify several subjects of crimes related to the activities of artificial intelligence: the manufacturer of the program; the manufacturer or seller of products equipped with artificial intelligence; the user and other persons involved. The results of the study can be used by the subjects of the legislative initiative to consolidate the novel proposed by the authors, which establishes the possible status of artificial intelligence as a subject of responsibility, and increased responsibility for the use of artificial intelligence technologies for criminal purposes.
