Annotation

Based on a systematic analysis and the method of dialectical contradictions, the article examines the most significant, from the point of view of the constitutional principles of legality and the presumption of innocence, accusatory legal and psychological factors prevailing in the criminal procedural activities of employees of criminal prosecution bodies and federal judges. The article substantiates the need to eliminate this type of factors by making specific legislative decisions that exclude contradictions between the purpose of criminal proceedings and the norms of the criminal procedure law regulating the activities of subjects of investigation and resolution of cases in line with the reliable establishment of the circumstances of the investigated act. The task of considering this problem also includes equipping students of the criminal law profile with knowledge about the accusatory legal and psychological factors prevailing in the criminal procedural activities of criminal justice bodies, which is important for improving the level of legal education at law faculties.
