Annotation

The article is devoted to the analysis of those most obvious trends that seem significant for understanding the features of the transformation of the system of legal norms in modern conditions. At the same time, these tendencies are fundamentally distinguished from the general patterns to which the change in law is subject in the historical perspective and which manifest themselves at any stage in the development of human society. Analyzing the reasons for the emergence of the identified trends, the author substantiates that the latter are determined primarily by the transformation of the environment in which law is reproduced and functions, as well as, to some extent, by the change in social expectations, with the implementation of which society associates the idea of the instrumental value of the rule of law. The existence of the identified trends, in turn, leads to a decrease in both the special legal and social effectiveness of law. The usefulness and, as a result, the demand for instrumental potential, which is objectively inherent in norms as legal means, are decreasing.
