Annotation
The article discusses the opinion that there is no common understanding of such legal categories as the form and source of law in legal science today. It is noted that
the value of the corresponding sequence has not been determined within the framework of displaying the balance of individual, public, as well as state interests, which, depending on the state ideology and political regime, may also oppose public interests in the classical sense. Also, in modern studies, such categories (definitions) as sources and forms of law are no longer identified and are not synonymous. Views on these categories in science are different. Regarding legitimation it is noted that it is inextricably correlated with the term of legitimacy and involves the recognition and confirmation of the legality (legitimacy) of power, social institution or status, authority. The formulated provisions and conclusions in the study allow us to assert that the understanding and study of the sources of law at the present stage should be considered taking into account the identification of the law forming will as a way that reflects the law forming intention.
