Annotation

This article is devoted to the study of the theoretical and methodological foundations of the welfare state doctrine. The author substantiates that the semantic content of this conceptual construction is associated with the need for a systematic study of the category of “legal doctrine”, as well as the scientific foundations of modern legal understanding. It is argued that modern models of social states are determined by the obligation of the subject to subordinate the behavior to legislative prescriptions and the obligation of the state to exercise law establishing and law enforcement functions in full accordance with the system of moral values of society. It is concluded that at various stages of historical development, social, political, economic and other socially determined factors had a decisive influence on the ratio of the constituent elements of the legal doctrine, changing the ratio of religious postulates, law enforcement abstractions, scientific ideas about law and justice, which form the basis of the phenomenon of legal reality.
