FREEDOM OF EXPRESSION AS A FACTOR IN LAW-MAKING OF THE NATION

The content of the concept of freedom of «expression», based on the analysis of the concepts of «will» and «declaration of will» is considered in the article. The characteristic of its nature, design and features is given. The correlation of the constructions «free will» and «freedom of will» is investigated. Circumstances which prove that freedom of expression is one of the factors of lawmaking are presented. The author substantiates the statement that freedom of expression is a factor in law-making of the nation (a referendum participant) and is a complex, multi-level structure with many internal and external connections. The research methodology includes a set of special legal methods which are standard for modern jurisprudence, primarily the formal legal method. In the context of interdisciplinary synthesis, the methodology of psychological science is used, which is associated with the study of the concept of «will».
