APPLICATION OF THE CONCEPT OF FAIRNESS TO THE ADMINISTRATIVE AND JURISDICTIONAL ACTS OF SPORT FEDERATIONS

The article summarizes and analyzes the guarantees of a fair resolution of disputes (natural justice) and due process (due process) in relation to jurisdictional and administrative decisions of sport federations and organizations. Both the application of the rules of various sports and the criteria (conditions) for admission to competitions and other authoritative instructions adopted not in order to resolve disputes and emanating from sports federations and organizations are meant by administrative decisions. The empirical main research is the practice of the Court of Arbitration for Sport (CAS) for the entire period. The author’s understanding of the concept of justice is presented, based on the system of self-testing of sports justice or verification of guarantees adapted for specific types of decisions. As a result of the research conclusions were drawn regarding the prospects for including the right to appeal against various acts in the regulatory systems of sports federations and organizations.
