Annotation
The article is devoted to the study of the theoretical and legal nature of space legal relations in the context of modern international and national space law. A comparative
analysis of Russian and Western (mainly American and European) approaches to regulating space activities has been conducted since 2015. Special attention is paid to fundamental differences in the interpretation of the principle of non-appropriation, the legal status of space resources and the role of private actors in space activities. The author analyzes the theoretical foundations of space legal relations, including the concepts of legal space, mobile territories and vertical sovereignty, developed by the Russian doctrine. The contradictions between Russia’s multilateral approach and the plurilateral initiatives of the West («Artemis Agreements») are investigated. It is concluded that it is necessary to develop a universal international legal regime for the use of space resources.
