Annotation

The article reveals the change in the ratio of customs and acts of royal authority used in the courts during the Middle Ages. In the early Middle Ages, customs were the main source of law, especially in Northern France. In the 13th century, by order of King Louis IX of France, French lawyers paid close attention to the systematization of legal customs in order to compile collections of customary law and compare legal customs with positive royal law. The article uses the method of analyzing the legal text and problem-historical analysis. The authors cite the periodization of the existence of legal custom, according to which the scholastic processing of ancient sources of canon and Roman law falls during the Middle Ages. It is noted that the kings of France initially had a positive attitude towards the preservation of legal customs in the regions, but as the central government strengthened, they came to the conclusion that it was necessary to systematize customary law. Thus, the relationship between power and popular custom evolved from the application of predominantly common law in the courts in the early Middle Ages to the coexistence of both custom and royal ordinances in the high Middle Ages and the dominance of royal legislation and its adaptation to the interests of state power in the late Middle Ages.
