Synergetic Approach and its Properties in the Methodology of Legal Research

The article considers the opinion that today the term synergetics is often used and used in legal science. From the point of view of synergy, law is considered as an open, non-linear system with chaotic (crisis, disequilibrium) processes, which, along with the generally established rules of behavior, are determined by many other legal phenomena. The author notes that the synergetic approach in the theory of law makes it possible to speak of law as a self-organizing system that is capable of establishing a spontaneous order and establishing a balance between social relations and their normative regulation, ensuring the dynamic sustainability of the development of these relations. Today legal understanding is in a state of reorientation from the stage of radical perception, as a set of state prescriptions or evaluative value characteristics, to the stage of recognizing the essence of law in its multidimensionality, the doctrine of which reflects the synergy between te spirit and purpose of law, the rule of law, and law enforcement. Thus, the methodological approach to legal understanding, taking into account the synergistic properties of systems, logically correlates with the theory of law, legal reality today develops according to the rules for reconciling internal contradictions that exist between the proper and the existent in law (positive and natural law), between the public and the individual (public and private interests), between the measure of freedom and necessity. Establishing such contradictions, finding ways to eliminate them is the most important task of jurisprudence.
